Terms of Service

Please read carefully. These Terms include a binding arbitration clause and class-action waiver (Section 17). They affect your legal rights.

1. Agreement to Terms

These Terms of Service ("Terms") form a binding agreement between you and HomeSkoolHelper LLC ("HomeSkoolHelper," "we," "us," or "our") and govern your use of the HomeSkoolHelper platform, website, and related services (collectively, the "Service").

By creating an account or otherwise accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old and legally able to enter into a binding contract in your jurisdiction. If you are using the Service on behalf of a household, you represent that you have authority to bind that household to these Terms.

2. The Service

HomeSkoolHelper is a web-based platform that helps homeschool families manage attendance, courses, grades, transcripts, portfolios, state compliance tracking, AI-assisted grading, curriculum recommendations, and related educational record-keeping.

The Service is a tool to assist with organization and documentation. It is not a school, a tutor, a lawyer, or an accreditation body, and it does not provide legal, educational, or professional advice. You remain solely responsible for your children's education and for compliance with all applicable homeschool laws and reporting requirements in your state or jurisdiction.

3. Eligibility and Accounts

To use the Service, you must:

  • Be at least 18 years old and able to form a legally binding contract
  • Provide accurate, current, and complete information when registering
  • Keep your account credentials confidential and secure
  • Be responsible for all activity that occurs under your account
  • Notify us immediately at support@homeskoolhelper.com if you suspect unauthorized access

Each Family plan account is for a single household. You may not share credentials outside your household, and you may not use the Service to manage records for children outside your legal care without proper authorization.

4. Free Trial

New accounts receive a 14-day free trial with full access to the features included in their selected plan. No payment information is required to begin the trial.

If you wish to continue using the Service after your trial ends, you must enter a payment method and subscribe to a paid plan. If you do not subscribe, your access will be limited at the end of the trial. We will keep your data in accordance with the Privacy Policy and the data retention section below.

5. Subscriptions, Billing, and Auto-Renewal

5.1 Plans and Pricing

Current pricing for the Family plan is $4.99 per month (includes the first child), plus $2.50 per additional child, with no additional charge after the fifth child. Annual billing is available at a discount displayed on our pricing page. Prices are in U.S. Dollars and exclude any applicable taxes, which will be added at checkout.

5.2 Auto-Renewal

Your subscription automatically renews at the end of each billing period (monthly or annual, as selected) at the then-current rate. We will charge your payment method on file for each renewal. You authorize us and our payment processor to do so until you cancel.

5.3 Cancellation

You may cancel your subscription at any time through your account settings (Settings → Billing) or by emailing support@homeskoolhelper.com. Cancellation takes effect at the end of the current paid billing period. You will continue to have access to paid features until that date. No partial refunds are issued for cancelling mid-period unless required by law.

5.4 Price Changes

We may change prices for future billing periods with at least 30 days' notice. New prices take effect on your next billing cycle after the notice period. If you do not agree to the new price, you may cancel before it takes effect.

5.5 Refunds

Except as required by law, all payments are non-refundable. If you believe you were billed in error, contact support@homeskoolhelper.com within 30 days of the charge.

5.6 Failed Payments

If a payment fails, we may suspend paid features until payment is resolved. We will attempt to notify you and may retry the charge in accordance with our payment processor's standard practices.

6. Your Content and License

"Your Content" means all data, records, documents, photos, files, and other content you create, upload, or generate through the Service. You retain ownership of Your Content.

You grant HomeSkoolHelper a limited, worldwide, royalty-free, non-exclusive license to host, store, transmit, process, reproduce, display, and create derivative works of Your Content solely as necessary to provide and improve the Service to you (for example, generating PDFs of transcripts, displaying portfolio items, or sending content to our AI provider when you use AI features). This license ends when you delete Your Content or close your account, except as needed to complete in-progress operations and for the retention periods described in the Privacy Policy.

You represent and warrant that Your Content is yours to upload, does not infringe any third party's rights, and complies with applicable law.

You are responsible for maintaining your own backups of important records. The Service is a convenience tool and is not a substitute for your own record-keeping practices, particularly where your state requires retention of homeschool records.

7. AI-Powered Features

Certain features of the Service use artificial intelligence, including AI grading of student work, curriculum recommendations, and compliance analysis. These features are tools to assist you and rely on third-party AI providers (currently Anthropic).

AI output is provided as a suggestion only. You are always responsible for reviewing, adjusting, accepting, or rejecting AI-generated grades, feedback, recommendations, or summaries before treating them as final. AI systems can make mistakes, including factual errors and misreadings of handwritten or photographed work.

Compliance content is not legal advice. State law summaries, requirement checklists, and notice templates provided by the Service are for informational purposes only. Laws change frequently. While we make reasonable efforts to keep this information current, you remain responsible for verifying current requirements with your state's education authority or a qualified attorney.

You agree not to rely solely on AI output for decisions with legal, medical, financial, or safety consequences.

8. Acceptable Use

You agree not to:

  • Use the Service to violate any law, regulation, or third-party right
  • Upload content that is unlawful, infringing, defamatory, obscene, harassing, threatening, or harmful to minors
  • Upload malware, viruses, or other harmful code
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems
  • Probe, scan, or test the vulnerability of the Service except under a written authorized testing arrangement
  • Use automated means (scrapers, bots, crawlers) to access the Service or extract content without our prior written permission, except for our own published APIs and feeds
  • Interfere with or disrupt the integrity or performance of the Service
  • Resell, sublicense, lease, or otherwise commercially exploit the Service
  • Reverse engineer, decompile, or attempt to derive source code, except where such restriction is prohibited by law
  • Use the Service to train competing AI models or to build a competing product
  • Submit content you do not have the right to submit, including third-party copyrighted material without authorization

9. Intellectual Property

The Service, including its software, design, text, graphics, logos, the "HomeSkoolHelper" name, the unicorn mascot, and all other content provided by us (excluding Your Content), is owned by HomeSkoolHelper LLC or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, personal, non-transferable, non-exclusive license to access and use the Service for its intended purpose, subject to these Terms.

You may not use our trademarks or branding without our prior written consent.

10. Copyright Complaints (DMCA)

We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice to our designated agent at support@homeskoolhelper.com including:

  • A physical or electronic signature of the copyright owner or authorized agent
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is allegedly infringing and information reasonably sufficient to permit us to locate it
  • Your contact information
  • A statement of good-faith belief that the use is not authorized
  • A statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act on behalf of the owner

We will respond to valid notices in accordance with the Digital Millennium Copyright Act and may terminate accounts of repeat infringers.

11. Third-Party Services and Links

The Service may integrate with or link to third-party services such as Google sign-in, Stripe payments, and various curriculum, field trip, or compliance information sources. We are not responsible for third-party services. Your use of those services is subject to their own terms and privacy policies.

12. Availability, Support, and Beta Features

We aim for high availability but do not guarantee uninterrupted access. The Service may be unavailable for scheduled maintenance, unscheduled outages, or events beyond our reasonable control. We support the Service via email and in-app channels; response times are not guaranteed.

We may, from time to time, offer beta, preview, or experimental features. Such features are provided "as is" without warranty and may be modified or discontinued at any time.

13. Termination

You may close your account at any time through account settings or by contacting support. Upon closure, paid features end at the end of your current billing period, and data is handled in accordance with the Privacy Policy (deletion from production within 30 days; backups within 90 days, except where retention is required by law).

We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, if required to comply with law, or to protect the Service or other users. For non-severe violations, we will use reasonable efforts to notify you and provide an opportunity to cure where appropriate.

Sections that by their nature should survive termination — including content licenses, disclaimers, limitations of liability, indemnification, dispute resolution, and miscellaneous — survive any termination.

14. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, HomeSkoolHelper disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and warranties arising from course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, error-free, accurate, secure, or that defects will be corrected. We do not warrant that the Service will meet your requirements or expectations or that AI-generated output will be accurate, complete, or current. You assume the entire risk of using the Service.

15. Limitation of Liability

To the maximum extent permitted by law, in no event shall HomeSkoolHelper LLC, its officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of records, loss of educational compliance status, business interruption, or substitute services, even if advised of the possibility of such damages.

Our aggregate liability arising out of or relating to the Service or these Terms, regardless of the form of action, shall not exceed the greater of (a) the amounts you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) $100 USD.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

16. Indemnification

You agree to defend, indemnify, and hold harmless HomeSkoolHelper LLC and its officers, directors, employees, agents, and licensors from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use of the Service, (b) your violation of these Terms, (c) Your Content, or (d) your violation of any law or third-party right.

17. Dispute Resolution; Binding Arbitration; Class-Action Waiver

Please read this section carefully. It affects your legal rights.

17.1 Informal Resolution

Before filing any formal action, you agree to first contact us at support@homeskoolhelper.com with a detailed description of the dispute. We will attempt to resolve the dispute informally within 60 days.

17.2 Binding Arbitration

If the dispute is not resolved informally, you and HomeSkoolHelper agree to resolve any dispute arising out of or relating to the Service or these Terms exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English, and judgment on the award may be entered in any court of competent jurisdiction.

17.3 Class-Action Waiver

You and HomeSkoolHelper agree that each may bring claims against the other only on an individual basis and not as a plaintiff or class member in any purported class, collective, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

17.4 Exceptions

Either party may bring (a) an individual action in small claims court, or (b) an action in court for injunctive or equitable relief to protect intellectual property rights.

17.5 30-Day Opt-Out

You may opt out of arbitration by emailing support@homeskoolhelper.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out will not affect any other portion of these Terms.

18. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Subject to Section 17, any judicial proceedings (limited to claims that may not be arbitrated) shall be brought exclusively in the state or federal courts located in Texas, and the parties consent to personal jurisdiction in those courts.

19. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by email at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you may stop using the Service and cancel your account before they take effect.

20. Miscellaneous

  • Entire agreement. These Terms, together with the Privacy Policy and any plan-specific terms, constitute the entire agreement between you and HomeSkoolHelper regarding the Service.
  • Severability. If any provision is held unenforceable, the remaining provisions remain in full force.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • No agency. No agency, partnership, joint venture, or employment is created by these Terms.
  • Force majeure. Neither party is liable for delays or failures caused by events beyond reasonable control.
  • Notices. We may give notice through the Service, by email to your registered address, or in any other reasonable manner. You may give notice to support@homeskoolhelper.com.
